DISPUTING THE DEBT
Yes you can dispute the debt. Sometimes, it is not your debt or maybe it was incurred so long ago that you honestly don't remember if it is a debt you incurred and are responsible to pay. We can help you verify this information under the law.
YOUR RIGHT TO VERIFICATION
Before just agreeing to pay, especially when contacted by a debt collector, you should always verify the information to see if it is a debt you legally owe. You have a legal right to demand verification that the debt is yours and that you legally owe it. We help clients with this and in many cases it is the first debt solution we pursue for a client.
STATUTE OF LIMITATIONS
Also, the debt may be too old to be legally valid. In Florida, debts based on a writing or an account and where no payment is made are only legally valid for five years from the time a payment was due and not made. This called the statute of limitations and when debts get too old, they cannot be sued upon to collect. This is why many times, our clients don't hear from a creditor or debt collector for four years or so, then all of sudden they start getting letters and phone calls. This is because someone calendered that five year deadline and they know they are running out of time to legally sue and get it reduced to Judgment.
THE DEBT BUYING BUSINESS
It is important to verify debts and dispute them when you have the legal grounds to do so. Many times, you will know that you owe the debt and it is legally valid but sometimes, accounts or collectors you don't recognize may not be your debts. Many debts are bought and sold by debt collectors and it may be that you just don't owe it.
